On This Day: Octoraro Creek case goes to trial

Charles Fell owned 123 acres along the Octoraro Creek in Little Britain Township in Lancaster County in 1880 . Further along the creek is a mill -- owned by Edwin Burnett, Josiah P. Lee, and Samuel T. Lee. It sits on the Chester County side of the creek. Fell alleges, with the Lancaster County Court of Common Pleas, that the three men raised the dam by two feet. By doing so, Fell alleged, the water now backs up on his farm, flooding the land and ruining the crops. Fell brought suit against the three men to recover damages and determine if they had a right to in fact raise the creek level. On This Day in 1880, the case was held over to trial.   Source Lancaster Daily Intelligencer. ( Lancaster , PA ), 5 October 1880. Chronicling America : Historic American Newspapers .
